STL FILES AND 3D MODEL USAGE AGREEMENT – LAST SWORD MINIATURES
ACUERDO DE USO DE LOS ARCHIVOS STL Y MODELOS 3D DE LAST SWORD MINIATURES
This agreement establishes the terms and conditions under which the license for Last Sword Miniatures STL files and 3D models is granted.
By purchasing, downloading, or using STL files from Last Sword Miniatures, you fully accept the terms of this agreement.
If you do not agree with any of the terms, do not purchase, download, or use the STL files in any way.
Este acuerdo establece los términos y condiciones bajo los cuales se otorga la licencia de uso sobre los archivos STL y modelos 3D de Last Sword Miniatures.
Al adquirir, descargar o utilizar archivos STL de Last Sword Miniatures, usted acepta los términos completos de este acuerdo.
Si no está de acuerdo con alguno de los términos, no compre, descargue ni utilice los archivos STL en ninguna forma.
1. LICENSE OF USE
LAST SWORD MINIATURES grants you a personal, non-exclusive, non-transferable, and non-sublicensable license to 3D print the STL files under the following conditions:
1.1) Personal Use
- You are allowed to 3D print the models contained in the STL files as many times as you like, exclusively for personal, non-commercial use.
1.2) Commercial Exploitation Prohibited
- You may not sell, rent, sublicense, or otherwise commercially exploit the STL files or any 3D-printed models derived from them, whether in whole or in part.
- You may not manufacture or mass-produce miniatures based on these STL files, whether using 3D printing or traditional production methods.
1.3) Modifications and Derivative Works
- You may resize, duplicate, or create derivative works of the 3D models contained in the STL files, provided that such modifications are strictly for personal, non-commercial use.
- You may NOT distribute, sell, or share modified STL files or their derivatives.
1.4) Distribution Restrictions
- You may not copy, distribute, share, publish, resell, or transmit the STL files in any form, whether free or for profit.
- You may not share physical 3D prints with third parties if they could be used for commercial purposes.
1.5) Copyright Protection
- STL files are protected by intellectual property rights and belong exclusively to LAST SWORD MINIATURES.
- LAST SWORD MINIATURES reserves the right to take legal action against any infringement of these terms.
1. LICENCIA DE USO
LAST SWORD MINIATURES otorga una licencia de uso personal, no exclusiva, no transferible y sin derecho a sublicencia, para la impresión en 3D de los archivos STL, con las siguientes condiciones:
1.1) Uso Personal
- Se permite la impresión en 3D de los modelos contenidos en los archivos STL en la cantidad que desee, siempre y cuando sea para uso personal y no comercial.
1.2) Prohibición de Comercialización
- No está permitido vender, alquilar, ceder, sublicenciar o explotar comercialmente los archivos STL ni las impresiones 3D derivadas de ellos, ni total ni parcialmente.
- No está permitido fabricar o producir en masa miniaturas basadas en estos archivos STL, ya sea mediante impresión 3D u otros métodos de producción.
1.3) Modificaciones y Obras Derivadas
- Se permite modificar el escalado, duplicar o crear versiones personalizadas de los modelos 3D contenidos en los archivos STL, siempre que dichas modificaciones sean para uso estrictamente personal y no comercial.
- No está permitido distribuir, vender o compartir archivos STL modificados ni sus derivados.
1.4) Prohibición de Distribución
- No está permitido copiar, distribuir, compartir, publicar, revender o transmitir los archivos STL en ninguna forma, ya sea gratuita o con fines lucrativos.
- No está permitido compartir impresiones físicas con terceros que puedan darles un uso comercial.
1.5) Protección de Derechos
- Los archivos STL están protegidos por derechos de propiedad intelectual y pertenecen exclusivamente a LAST SWORD MINIATURES.
- LAST SWORD MINIATURES se reserva el derecho de tomar acciones legales contra cualquier infracción de estos términos.
2. LIABILITY
2.1) User Responsibility
LAST SWORD MINIATURES shall not be held liable for any damage, malfunctions, or failures that may occur to devices, 3D printers, or materials as a result of using the STL files.
2.2) No Technical Support
LAST SWORD MINIATURES is not obligated to provide technical support, assistance, or advice regarding the use of STL files or the printing of 3D models.
2.3) License Modifications
LAST SWORD MINIATURES reserves the right to modify the terms of this license at any time without prior notice to ensure compliance with current regulations and the protection of its intellectual property.
2. RESPONSABILIDAD
2.1) Uso bajo Responsabilidad del Usuario
LAST SWORD MINIATURES no se hace responsable de posibles daños, fallos o averías que puedan producirse en dispositivos, impresoras 3D o materiales como resultado del uso de los archivos STL.
2.2) Ausencia de Soporte Técnico
LAST SWORD MINIATURES no está obligado a proporcionar soporte técnico, asistencia o asesoramiento sobre el uso de los archivos STL ni sobre la impresión de los modelos 3D.
2.3) Modificaciones en la Licencia
LAST SWORD MINIATURES se reserva el derecho de modificar los términos de esta licencia en cualquier momento sin necesidad de previo aviso, asegurando el cumplimiento de la normativa vigente y la protección de su propiedad intelectual.
3. JURISDICTION AND APPLICABLE LAW
3.1) Governing Law
This agreement shall be governed by the applicable laws of Spain, including the Intellectual Property Law (Royal Legislative Decree 1/1996) and the relevant provisions of the Criminal Code regarding intellectual property and fraud.
3.2) Jurisdiction
For any disputes arising from this agreement, both parties expressly waive any other applicable jurisdiction and submit to the exclusive jurisdiction of the Courts and Tribunals of Móstoles (Spain).
3. JURISDICCIÓN Y LEGISLACIÓN APLICABLE
3.1) Legislación Vigente
Este acuerdo se regirá por la legislación vigente en España, incluyendo la Ley de Propiedad Intelectual (Real Decreto Legislativo 1/1996) y las disposiciones del Código Penal en materia de propiedad intelectual y fraude.
3.2) Jurisdicción
Para cualquier controversia derivada del presente acuerdo, ambas partes renuncian expresamente a cualquier otro fuero y se someten a la jurisdicción y competencia exclusiva de los Juzgados y Tribunales de Móstoles (España).
4. BREACH OF TERMS AND PENALTIES
4.1) Consequences of Non-Compliance
Failure to comply with this license may result in:
- Immediate termination of the license without refund.
- Legal action (civil and criminal) for copyright infringement.
- Financial claims for damages caused to LAST SWORD MINIATURES.
4.2) Protection Measures
LAST SWORD MINIATURES may use technological and legal measures to detect, track, and prevent unauthorized distribution of its STL files and 3D models.
4. INCUMPLIMIENTO Y SANCIONES
4.1) Consecuencias del Incumplimiento
El incumplimiento de los términos de esta licencia podrá dar lugar a:
- Cancelación inmediata de la licencia sin derecho a reembolso.
- Acciones legales civiles y penales por infracción de derechos de autor.
- Reclamaciones económicas por daños y perjuicios causados a LAST SWORD MINIATURES.
4.2) Medidas de Protección
LAST SWORD MINIATURES podrá emplear medidas tecnológicas y legales para detectar, rastrear y prevenir la distribución no autorizada de sus archivos STL y modelos 3D.
